Family pet missing - found at neighbors - needs suggestions on how to get her back

My name is Jonathon and I live in Seymour... I had the most wonderful red/copper husky (she's the one on the right, with her boyfriend, Kodah) who, unfortunately (as huskies do) got out of our yard back in mid March.

My wife and I chased her down, barefoot, through gravel, broken glass, etc etc. we loved that dog and wanted her back, but unfortunately she darted around a corner and we never saw her again...

So, we did the next thing we knew. We called around to all of the shelters in the area, we put up fliers in our neighborhood, we called the police in hopes that someone would call them and turn her in, and I even put an add or two up on here... After about a month though, unfortunately, we figured that since she was an unfixed female and we hadn't heard anything, that she had been picked up and we weren't going to get her back...

Anyway, where I'm headed with this, while we were walking to the Circle K for pops the other night, we saw her chained up in a guy's back yard, only A BLOCK AWAY FROM OUR HOUSE!!!

My wife confronted him about it, and he lied saying that "he had had her for a year, etc etc, and that she was his dog". We called the police, and explained to them what was going on. We have pictures, videos, etc etc to show that she was ours, and we have the documented call stating when she got out from the police department, and we also have the owner who gave her to us's contact info... Anyway, the police went over and talked to the guy.

She is wearing the same collar she was wearing when she got out, so the guy now magically wants to give her back, but the female does not. She is saying that she put an add in the paper and that no one claimed her, so she is now a part of their family and we aren't getting her back... What I need to know is, if I were to take this to court, do you think I would win and get my dog back?

I don't really want to have to pay money for court fees, but if it's what I have to do to get my dog back, I will do so... If nothing else, I would be looking for anyone who has a husky they would not mind letting me have for either free or a reasonable re-homing fee (because I don't work, it would be a little bit before I am able to pay anything out for a dog other than mine, my wife is our only source of income right now)

Unless anyone is really good at convincing speaking, and would like to come down and try to convince her to let us have our dog back, I'm not sure what else to do right now unless someone else has any suggestions? Pleas help us get our dog back? We want her back, Kodah wants her back, and we want her to be a part of our family where she belongs...

Does the dog want to come back?
I would think that if the current 'owners' made a reasonable effort to locate you (through an ad), and you didn't respond, then the dog now belongs to them, technically.
Looks like your best course of action is to plead with the woman, and hope she is sympathetic and understanding.
What is best for the dog?
It's unfortunate, but live and learn.

no. you shouldn't get your dog back. unless you spay her and microchip her.

I tend to agree with Karma. In this world of overbreeding why would you not have the dog spayed? I think that maybe instead of getting yet another dog that you won't able to afford, as you said yourself you aren't working right now, you should focus on the one you do have. I can tell you this much, if my babygirl went missing there is no way in hell she would be chained up a block from me and me not notice. I would be searching day and night until i found her. Sounds like you gave up on finding her and they took her in. I hate to think of any dog chained in a yard at all but its better than her running loose.

I wouldn't of called anyone, I would of taken my dog. If the dog is out again, take her back. If the police can't make them give her back to you then they can't make you give her back to them either.

You are not a professor and this is not college work. I have a GPA of 3.70 have completed 2 years of my Bachlors degree in Applied Behavioral Sciences. I tested out of English and Math so didn't have to take them. I also have a associates degree in Business Management and a certificate in Medical Insurance billing. I am always on the Deans list at every program I have attended and always finish with a high GPA so I could really care less about what you have to say. Find something to do beside being my grammer nazi stalker!!
