The email issued was with good intentions to protecting the City of Columbus, but may have been misinterpreted who the law applies too. However the City Vehicles may fall under Commercial but I don't think they all do.

An email issued out by Keeth Reeves, Director of the City Utilities said the following...

Subject: Federal cell phone ban starts January 3rd

I'm not in a position to provide much more detail than the article in this link provides, but it appears that it is now a Federal offense for a Commercial driver to use a cell phone while rolling.

Since we use cell phones to communicate with our field personnel, we need to caution drivers to pull over and park before calling or answering.  They also need to know that, like speeding tickets and seat belt violations the CCU will not be paying any fines incurred while a driver is breaking the law, which according to the article may be as much as $2,750.

What Keith fails to mention is this isn't a Federal Ban for everyone but for commercial motor vehicles only.

Here is the information they may have been confusing with City vehicles.

"The law in effect Tuesday, Jan 3rd and will make it illegal for commercial truck drivers to use a hand-held cell phones while driving.

Transportation officials believe the new federal law will help make interstates safer for commuters.  Some critics of the law say the penalties are way too stiff.  If a commercial truck driver is caught talking on a hand-held cell phone, they could face over $2,700 in fines for each offense.  In addition, the driver's employer could face up to $11,000 in fines.

The law doesn't ban the use of a hands free devices such as a blutooth headset or those which allow the driver to answer a call with the push of a single button, but does not require the driver to hold the device.  The law futher expands to bus drivers."

What is a commerical vehicle?

The most recognizable commercial motor vehicle is typically a Class 7 or 8 big rig or tractor-trailer rig, commonly known as an 18-wheeler.

Once again the director of the city utilities has made a bad decision. Who does he report to and why isn't he ever held accountable for anything! Why is he still the director of the utilities??
