Gun pulled on Hope resident - "I feared for my life & Hope PD didn't do anything"

Brian pulled a gun on me and my friend in front of his child and Hope Police didn't do anything about it.. Not only got to keep the gun but they couldn't press any charges.

Matthew Zollman feared for his life when Brian Cowan allegedly pulled a 45 Caliber Rock island m1911 on him and his friend. It all started when Brian was allergy was speeding down Walnut street while kids playing nearby. So Matthew and his friend Chris yelled to slow down so Brian stopped and Matthew and Chris walked up the car Brian was in.

Matthew explained to Brian not to drive that fast down the road. That is when Brian pulled out a chrome 45 with a woodgrain handle. Brian then pointed it at Matthew and Chris. "I feared for my life." Matthew said.

Matthew called the police to report this incident, but was told it wasn't anything but hearsay. 

Matthew said "Permit or not, it doesn't give Brian the right to pull his gun out and point it at someone. You never point a gun at someone unless you intend to kill them. 

It's either aggravated assault with a deadly weapon and intent to use that weapon and cause bodily harm or intimidation with a deadly weapon.

It falls under one of those two categories. I feared for my life. & HPD didn't do anything about it..."

Brian was 18 when he received his gun in January which he Facebooked about, and reports this isn't the first time he has flashed and or pointed the gun at others. 

Several person have mentioned this isn't the first time -

"Brian pulled a gun on you? Brian pulled one on my neighbor just a couple days ago... And HopePD gave it right back to him..."

"He pulled a gun boog too with his son with him.. Someone needs to tell him just cause you have a gun don't mean u can point it at the wrong person."

Brian had this to say... "Lol don't u love it when 4 guys surround ur car then u pull a surprise out of center console and they shut there f**king mouths then they call cops and u get searched and they see u have a permit"

His story... "I waz driving down the street three guys jumped in front of my car all three in my window saying there ganna beat my ass so I told them to get the fuck out of my window Chris king grabbed my throat so I took my fire arm out of my center console set in in my lap not pointing it at like they say its facing steering wheel my hand want even on it and I said I'm not ganna fuck with u guys no kid waz even in site I have witnesses "

Now here is the legals... 

Intimidation with a deadly weapon (if the victim admits that he was "scared for his life") and pointing a firearm. Now, pointing a firearm that is loaded is a felony (class D).

Pointing a firearm that is not loaded is a misdemeanor (class A).

Here is where those calls get difficult.

If the police are called and arrive to speak to both parties, they can obtain a statement from the victim. IF the gun is located, it is a dead to rights custodial arrest for intimidation and pointing a firearm.

IF the gun is not located and there are no thrid party witnesses, a report is completed, statements taken and the info. is forwarded to the prosecutor's office for review of charges. If the pros. office feels that only the statement is sufficient evidence, they will move forward with charges.

IF a person points a BB gun at another person, that person commits intimidation with a deadly weapon.

If the victim feels in fear of his life, it covers the statute. Even though its a BB gun, the courts have ruled that a reasonable person should not be required to determine the caliber of the threat.

A gun is a gun in there book, unless of course it is a toy unable to shoot a projectile, then the crime would be intimidation as a misdemenaor.

Both incidents were the same inincidents and that lady is methed out. Really surpised she can even handle a faceboook. Brian didnt do anything wrong and has never pulled a gun on anyone. Hope is a small town and he came acrossed a group that all ready disliked him. Dont you think if this was the third time that he had his gun taken away he wouldnt have it?? Thats what i thought first problem hes ever had with that gun.

Im sure Mr. Zollman was no "innocent" in this case. He has a long history of writing $100 checks with his mouth, that his $5 behind could not cover. To go along with that, Mr. Cowan should not be allowed a permit, let alone a weapon in the first place.

In any instance NOBODY from this site will ever know the entire story.There are 3 sides to every story. What Mr. Zollman and his friends say happened, What Mr. Cowan said, and what actually happened. It's obvious from this "editorial" to see that.

So, before blaming the Police for not doing anything when this guy "feared for his life" know the facts. That is personally my biggest complaint about this site. They claim to be wanting to be "journalists" or "report things that The Republic" will not. But, seems like just a big rumor mill that has been started by somebody who has nothing better to do with their time than to start drama in other peoples lives. So, you guys should really change the name of your web site to "The Drama Llama" More fitting name.

First of all it is "already" not "all ready" *****!
Second there is(are) three sides to this story not every story you ****#2.
Both of you should be disciplined! As far as this report goes any matter concerning a gun should be looked into thoroughly but HPD isn't a top notch department and prob didn't have anyone to volunteer their time to this case LOL Rookie cops wanting to be paid. Children these days pull guns because they are scared to get beat up unlike the old days where a good whoopin is what made you a man. Obviously Matt is a man for from what I can tell he was ready to fight not threatin and run away. That's enough though Karma will take care of the rest. GOODNIGHT.

Less writing and more reading please. If you can't express your opinion in a way people can read and comprehend then you might as well not share it. I don't need to hear your understanding of the law when you are illustrating you have no understanding of the English language. Cops love to take people to jail....if they didn't then there was probably no crime committed.
